What is a court filing fee?
California courts charge fees for filing most documents, including an Answer to a civil complaint. The amount varies by court and case type, typically ranging from $30 to $435 or more for civil cases.
If you cannot afford the filing fee, California allows you to apply for a fee waiver.
The fee waiver forms: FW-001 and FW-003
California uses two forms for fee waivers:
- FW-001 (Request to Waive Court Fees) — this is the application you submit requesting that the court waive your filing fees. You provide financial information about your income, expenses, and assets.
- FW-003 (Order on Court Fee Waiver) — this is the form the court fills out and signs indicating whether your request was granted or denied.
How to apply
To apply for a fee waiver:
- Complete FW-001 with your financial information
- File FW-001 with the court clerk at the same time you file your Answer
- The court will review your application and issue an FW-003 order
- If approved, your filing fee will be waived

FW-001 and FW-003 contain your personal financial information. These forms are confidential and must be filed directly with the court clerk.
Do NOT serve FW-001 or FW-003 on the opposing party or their attorney.You are not required to share your financial information with the other side. Serving these forms on the opposing party is an error that could expose your private financial information unnecessarily.
